General Terms and Conditions

These General Terms and Conditions, hereinafter referred to as the T and C, define the conditions applicable to sales made between, on one hand, the CAMIREL company, a limited liability company, registered with the Toulon register of trade and companies under the number B 510 670 391, and, on the other hand, those who want to buy Les Loulous de la plage products via the website

Any order relating to one or more of the items offered for sale by the CAMIREL company implies express acceptance by the buyer of these T and C which may be supplemented by specific special conditions. In this case, the specific special conditions form an indivisible whole with these T and C.

Furthermore, all exemptions to these T and C granted by the CAMIREL company shall only be applicable to the order in question and cannot be applied by the customer to the CAMIREL company in connection with other orders, whether placed earlier or later.

Article 1 - Validity of offers: The offers available on the website are directed only to consumers with a delivery address in mainland France, Corsica, Monaco and Andorra, as well as in some European countries (Germany, Belgium, Spain, Ireland, Greece, Italy, Luxembourg, the Netherlands, Portugal, the United Kingdom, and Switzerland). The products shown on the website are only available while stocks last. The CAMIREL company reserves the right to cancel or refuse any order from a customer with whom there has been a dispute over payment of a previous order or whom it considers may present a risk of any kind. In the event of an order for men's swim shorts becoming unavailable for any reason whatsoever, the CAMIREL company undertakes to inform the customer as soon as possible by email and give them a refund within a maximum period of 3 business days.

Article 2 - Prices of products: Product prices are indicated in euros including all taxes but do not include the customer's contribution to shipping costs. All the orders, whatever their origin, are payable in euros. CAMIREL reserves the right to change its prices up or down at any time and without prior notice. The products are billed based on rates in force at the time offinal validation of the order by the customer. The shipping costs are invoiced as extra and calculated according to weight, the country of destination and the mode of transport chosen by the client. For all deliveries outside of the European Union, customs taxes and formalities are, unless otherwise indicated, the exclusive responsibility of the client who is committed to checking the possibilities of importing products into the country of delivery.

Article 3 - Product Presentation: The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions should have occurred in this presentation, CAMIREL's liability cannot be engaged. The photographs illustrating the products are true to life, but do not enter the contractual field.

- Intellectual Property: All the texts, commentaries, works, illustrations and images reproduced on the websites edited by CAMIREL are reserved as the author's right as well as intellectual property for the whole world. All total or partial reproductions of the websites edited by CAMIREL are strictly forbidden. CAMIREL reserves the right to claim damages.

Article 4 - Payment: Payment for purchases made on Les Loulous de la plage website is made on the (Systempay SPplus) secure online payment platform of Caisse d'Epargne. Payment by check, bank transfer or via (PayPal) can also be accepted. Caisse d'Epargne and CAMIREL implement all means to ensure the security of banking data transmitted during your payment. As such, Caisse d'Epargne uses a secure SSL (Secure Socket Layer) type module. The bank cards accepted are Carte Bleue, Visa and Mastercard. American Express cards and store cards (Aurore etc.) are not accepted. Shipping of the order will be made only after validation of the payment.

Article 5 - Shipping and Delivery: Any order placed on the website from Monday to Friday will be prepared and given to the carrier within a maximum of 2 business days. Delivery will then be carried out by Colissimo within a time period of between 48 and 72 hours after your order leaves the warehouses of the CAMIREL company. Upon delivery, it is the recipient's responsibility to check the condition of the order and make any reserves or complaints which would appear justified, or even to refuse the package, if it is likely to have been opened or if it shows obvious signs of damage. In the event that the carrier should be unable to deliver to the customer due to an incorrect or incomplete address, or a refusal of the package by the customer, the products will be returned to the CAMIREL company. Upon receipt, either a credit will be created in the customer's space for the cost of the products concerned, less incurred shipping costs, or the customer can have the package redelivered and must pay the return postage. In this case, the delivery times indicated in these general conditions do not apply anymore.

Regarding signed-for shipping by Colissimo, in the event of absence on the day of delivery, the postman will leave a delivery notice in the customer's mailbox. This notice will allow you to collect the package from the post office, during its opening hours, within 15 clear days. In the event that the package should be lost by La Poste during its delivery, the customer will inform the CAMIREL company of its non-delivery via the contact form on our website, they should also make a complaint to the postal service. CAMIREL will also contact La Poste in order to conduct an investigation. This can take up to 21 days. If, during this period, the package should be found, it will be immediately re-routed to the customer's home. On the other hand, if the product is not found at the end of the period of 21 days of investigation, La Poste will consider that the package has been lost. All risks pass to the buyer as soon as the merchandise has been handed over to the postal services. During this period, no refund or return can be made. The CAMIREL company cannot be held liable for consequences related to late delivery or loss of the package by the carrier. The delivery times of our men's swimwear models are given as a rough guide and do not bind CAMIREL Diffusion Sarl.

Article 6 - Shipping: Shipping charges include packaging, handling and postage costs. These charges vary depending on the total cost of the order and the shipping method chosen. The CAMIREL company offers delivery via Colissimo Suivi (tracked delivery without signature), via Colissimo Expert (signed-for delivery), or Chronopost for urgent shipments. Standard shipping costs vary depending on the country of delivery and the method chosen. Please note that there is free shipping for orders over 84.00 euros inc. taxes to be delivered by Colissimo Suivi (tracked delivery without signature) in mainland France, Corsica and Monaco.

- Customs Taxes: Customs or importation taxes are owed as soon as the parcel reaches its country of destination. You should pay off possible supplementary customs clearance taxes. We have no control over these taxes and cannot predict what they may be, as the customs policies vary strongly from one country to another. Please contact your local customs office for more detailed information.

Article 7 - Exchange, return and refund: According to the law, the customer has a period of 15 days (from the date of receipt of the goods) to exchange or cancel their order by exercising their legal right to withdraw. Any exchange or return must be subject to a prior request for exchange or return to the customer service of the CAMIREL company. As set out in law, return shipping costs are the sole responsibility of the customer, whether for an order cancellation or an exchange. the client can only return the articles if the original labels are still intact, if the merchandise has not undergone any deterioration, and if the article has been returned in its original packaging. This is excluding all products that have been altered, damaged, used, and even worn even once. Upon receipt of the package, the CAMIREL company will assess the perfect condition of the goods returned. No returns will be accepted if the returned products have been visibly used or damaged by the customer and that such use or damage should render the products unfit for sale. If the return is refused by CAMIREL, the products will be returned to the customer at their own expense on a counter-refund basis, without the customer have the right to any compensation. In the event of cancellation, the cost of the products to be refunded will be re-credited within a maximum of 15 business days to the bank card used to pay for the order. In the event of exchange, a credit to the value of the goods returned and original shipping costs will be paid to the customer account used to place the order. Once completed, this replacement order will be prepared and shipped within the same time frame as a normal order.

As we invite you to verify your size before confirming your purchase, you will be asked to bear the return costs. Our creations of swimsuits for women are designed using international sizes, our size guide allows you to confirm your exact measurements. Such return costs amount to 5 Euro, which you should necessarily include with your return.

Furthermore, should you wish to be reimbursed for your purchase, a discount of 15% will be deducted to cover our picking, verification and restocking costs. The shipment charges which you paid or that we would have offered you will not be either refund or paid by our company. The possible: catalog, gifts, bag, pocket mirror etc. not appearing on your invoice and which were delivered with your order, must also necessarily be returned.

Article 9 - Application methods: These T and C may be subject to change with or without notice, therefore, the customer is invited to consult these conditions each time an order is placed. If any provisions in these T and C should be contrary to existing law, whether national or international, only the provision in question will be disregarded, the contract remaining valid for all other provisions.

Article 10 - Applicable laws: These T and C are governed by French law in force on the date of conclusion of the contract. In terms of jurisdiction, only the Tribunal de Commerce of Toulon will be competent to decide on any dispute relating to the application or interpretation of these T and C and acts resulting from them.
